Consumer Health Data Policy

Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy ("Policy") explains how Posie, Inc. ("Posie," "we," "us," or "our") collects, uses, shares, and protects Consumer Health Data, as defined by the Washington My Health My Data Act, Nevada Senate Bill 370, and the Connecticut Data Privacy Act. It applies to Consumer Health Data we collect through posie.co, the Posie mobile app (the "App"), and any other services that link to this Policy (together, the "Services"), about residents of Washington, Nevada, and Connecticut, and about anyone whose Consumer Health Data is collected in Washington.

This Policy supplements our Privacy Policy. If this Policy conflicts with the Privacy Policy on how Consumer Health Data is handled, this Policy controls.

Our Commitments

  • We collect Consumer Health Data only as necessary to provide the products and services you request, or with your consent.
  • We do not sell Consumer Health Data.
  • We do not use Consumer Health Data for targeted advertising, and we do not share it with advertising or marketing partners.
  • We share Consumer Health Data only with service providers that process it on our behalf under contract, or as described in this Policy.
  • We do not use geofencing around health care facilities.

Examples and Why We Collect It

Sleep and wellness information

Examples: answers to our sleep quiz, your sleep habits, patterns, and goals, and information you choose to log in the App.

Why: to provide the product recommendations you request, operate App features, and tailor your experience with the Services.

Health conditions and supplement use

Examples: information that you are experiencing sleep difficulties or other symptoms, or that you use supplements or over-the-counter products, including what can be inferred from your purchase of Posie products.

Why: to process and ship your orders, manage your subscription, provide customer support, and answer your product questions.

Health and safety information

Examples: information about an adverse reaction or other health concern related to our products.

Why: to respond to you, investigate product safety, and meet our legal obligations, including reporting serious adverse events to the U.S. Food and Drug Administration (FDA).

Accessibility information

Examples: information you share with us about a disability or an accommodation you need.

Why: to help you access our products and Services.

Identifiers linked to health data

Examples: your name, email address, phone number, shipping address, account and order details, and IP address, when connected to the data above.

Why: to link data to your account, communicate with you about your orders and requests, and provide support.

We may also use Consumer Health Data as necessary to keep the Services secure, prevent fraud, troubleshoot problems, and comply with the law. We will not use Consumer Health Data for any other purpose without first asking for your consent.

Where We Get Consumer Health Data

  • Directly from you, when you take our sleep quiz, create an account, place an order, use the App, or contact our customer support team by email or chat.
  • From your use of the App, when you choose to log sleep or wellness information.
  • By inference, for example from your purchase of Posie products.

Your Consent

Where the law requires it, we ask for your consent before collecting Consumer Health Data beyond what is necessary to provide the products and services you request, and we ask for separate consent before sharing it for any purpose not described in this Policy. You can withdraw your consent at any time by emailing support@posie.co or through your App settings. Withdrawing consent does not affect processing that already took place, but it may limit some features of the Services.

How We Share Consumer Health Data

Categories of Consumer Health Data we share: any of the categories listed above, only as needed for the purposes described in this Policy.

Who we share it with:

  • Service providers (processors) that help us run our business under contracts that limit how they can use the data, including providers of e-commerce and payment processing, subscription management, customer support, cloud hosting and App infrastructure, order and account communications, and shipping and fulfillment. These currently include Shopify, Recharge, Gorgias, and Klaviyo.
  • Government regulators, such as the FDA, when we are required by law to report adverse events.
  • Law enforcement and other parties, when required to comply with the law or legal process, or as necessary to prevent, detect, or respond to security incidents, fraud, or other illegal activity.
  • A buyer or successor, in connection with a merger, acquisition, bankruptcy, or sale of assets, subject to applicable law.
  • Anyone else, with your consent.

Posie does not currently have any affiliates with which we share Consumer Health Data. We do not permit third parties to collect Consumer Health Data about your online activities over time and across different websites or online services through our Services.

Your Rights

Depending on where you live, you have the right to:

  • Confirm and access: confirm whether we collect, share, or sell your Consumer Health Data, access that data, and receive a list of all third parties and affiliates with which we have shared it, along with their contact information.
  • Withdraw consent: withdraw your consent to our collection and sharing of your Consumer Health Data.
  • Delete: have us delete your Consumer Health Data. We will also notify our service providers to delete it. Data stored in archives or backups will be deleted within 6 months of your request.
  • Stop collection or sharing (Nevada): ask us to stop collecting or sharing your Consumer Health Data.

To make a request, email support@posie.co with the subject line "Consumer Health Data Request." We may need to verify your identity before completing your request. We will respond within 45 days, and if we need more time (up to an additional 45 days), we will tell you why. Requests are free of charge up to twice in any 12-month period.

Appeals. If we deny your request, you can appeal by emailing support@posie.co with the subject line "Consumer Health Data Appeal." We will respond in writing within 45 days and explain our decision. If your appeal is denied, you may contact the Attorney General of your state.

Security and Retention

We limit access to Consumer Health Data to employees and service providers who need it to perform the purposes described in this Policy, and we use administrative, technical, and physical safeguards designed to protect it. We keep Consumer Health Data only as long as needed for those purposes or as required by law.

Changes to This Policy

We will post any changes to this Policy on this page and update the date above. If we make a material change to how we collect, use, or share Consumer Health Data, we will notify you and obtain your consent where required by law before applying the change to data we have already collected.
